(“BraveHeartNation,” “we,” “our,” or “us”) makes its services at www.braveheartnation.com, mobile applications downloadable here (for iOS version) or here (for Android version), and related sub-domains, services, and products controlled by BraveHeartNation.com, and any other interaction with BraveHeartNation.com (collectively, “Services”) available for your use subject to these Terms of Use (“Agreement”).

By downloading, accessing, ordering, or using any of our Services, clicking on the “I accept” button, or completing the registration process, you represent that you have read, understand, and agree to be bound by this Agreement. The term “you” or “your” refers to anyone who uses any portion of our Services. If you do not agree to be bound by this Agreement, you may not access or use our Services.

USER ELIGIBILITY

You are over the age of 16. Only individuals over the age of 16 may use the Services or provide Personal Data (as defined in our Privacy Policy) through the Services, e.g., the person’s name, address, or contact information. If you are over age 16 you represent and guarantee that you have express authorization by your parent or legal guardian to accept and abide by the terms of this Agreement.

YOUR MEMBERSHIP AND OUR SERVICES

BraveHeartNation as a Neutral Venue

We are a digital social marketplace intended to connect members of the wellness community. We do not endorse any products, service providers, or vendors nor do we function as an agent representative for any Member (as defined below).

We and the Services function solely as a neutral venue and digital social marketplace where members of the health community can connect with other like-minded members. We provide a venue for members to interact; however, we are not involved in or a party to any actual transactions between Members.

We assume no control over the quality, accuracy, safety, or legality of the transactions that take place as a result of your connections made on our Services. We also do not verify or endorse the accuracy of any sponsored content or vendor listings. We assume no control over the provision of items or services, nor do we assume the ability of anyone to pay for any goods and services.

We make no representations or warranties and are not liable or responsible for the actions or inactions of our Members.

YOUR ACCOUNT REGISTRATION

To access certain Services, you will be required to register and create an account and provide certain registration details.

Your account on BraveHeartNation.com (your “BHN Account”) gives you the right to access the Services at our sole discretion.

We maintain different types of BraveHeartNation.com Accounts for different types of Members as described below.

If you open a BraveHeartNation.com Account on behalf of a company, organization, or other business structure (the “Entity”), then:

1. “You” includes you and that Entity; and
2. You represent and warrant that you are an authorized representative of the Entity with the authority to bind the Entity to this Agreement, and that you agree to this Agreement on the Entity’s behalf.

For some of our Services to operate correctly, you must provide accurate and complete information as prompted by the account registration processes. You represent and warrant that the information you provide in connection with your use of Services is true, accurate, and complete.

By connecting to BraveHeartNation.com Services with a third-party service, you give us permission to access and use your information from that service as permitted by that third party, and to store your log-in credentials for that service. For more information on how we use your information, please see our Privacy Policy.

MEMBERSHIP TYPES

• Basic Membership: Access to basic content is provided free of charge.
• VIP Membership: Paid membership offering enhanced features and content across all BraveHeartNation platforms solely for VERIFIED PRACTITIONERS.
• Free Trial: We offer a 3-day free trial for the VIP Membership. After the 3-day trial period, your subscription will automatically convert to a paid VIP Membership unless canceled before the trial ends. The subscription costs $14.99 per month or $129.99 per year, depending on your selection during subscription choice.

SUBSCRIPTION DETAILS

If you choose to continue after the trial, you will be charged $14.99 per month or $129.99 annually. Your subscription will auto-renew unless canceled. You can cancel anytime before the trial ends to avoid being charged. To manage or cancel your subscription, visit your account settings. IF purchased through Apple Store or Android Store, visit your device subscriptions settings accordingly to modify or cancel your subscription.

MEMBERSHIP FEES AND PAYMENT

Fees: VIP Members will enter into an annual or monthly subscription at a cost determined by BraveHeartNation.com from time to time. Fees will be paid annually or monthly in advance before the start date of the subscription term.

During the Subscription Term:

• BraveHeartNation.com may add new services for additional charges or change fees for existing services at its sole discretion.
• Any changes will be updated on our website or app. Changes to our pricing shall become effective in the next subscription term.

Billing Contact: Unless otherwise designated by the VIP Member, any person designated as the billing contact in the billing record for an entity's account will be deemed to assume the rights and obligations of the VIP Member.

RENEWAL AND CANCELLATION

VIP Memberships automatically renew for the subscription term unless the VIP Member provides BraveHeartNation.com with notice of their intention to cancel their VIP Membership no less than one month before the end of the current subscription term.

Payment Processing:

• BraveHeartNation.com will charge the payment method on file on the first day of each subscription term.
• If your subscription is through the Apple or Google stores, charges will occur based on their respective store terms.

Failed Payments:

If the payment method on file becomes invalid and BraveHeartNation.com is unable to charge you on the first day of the next subscription term, we reserve the right to immediately terminate your VIP Membership.

Cancellation Policy:

• You may cancel the VIP Membership at least 30 calendar days before the end of the current subscription term.
• The cancellation will take effect on the first day of the next subscription term.
• You will retain access to the services from the time you cancel until the start date of the next subscription term.
• No refunds or credits will be provided for any remaining days in your current subscription term.

Post-Termination Use:

After your VIP Membership expires or terminates, you may continue to use the Basic Membership, subject to this Agreement.

ONLINE SHOP AND PAYMENT PROCESSING

BraveHeartNation.com’s online shop allows you to order BraveHeartNation.com and DocofDetox.com products.

Powered by Third Parties:

• BraveHeartNation.com is not a payment processor and does not collect payments directly for products or services.
• Payment processing is managed by third-party payment processors (“Payment Processor”).

Payment Processor Responsibility:

• You may be redirected to an external website operated by the Payment Processor for purchasing goods or services.
• BraveHeartNation.com does not guarantee the privacy or security practices of the Payment Processor and assumes no responsibility for their content or practices.
• Personal information provided to the Payment Processor will be governed by their privacy policy and terms of use.

User Liability:

You are solely responsible for all charges that occur through a Payment Processor. BraveHeartNation.com is not liable for lost, stolen, or incorrectly processed payments.

LICENSE TO USE SERVICES AND CONTENT

Our services may include data or creative expression such as text, software, images, graphics, photos, audio, videos, user interfaces, logos, designs, and other materials collectively referred to as “Content.”

MEMBER CONTENT

Ownership: You own your Member Content. If any content violates intellectual property rights, please contact us.

License to Use Your Content: By submitting Member Content, you grant us a transferable, non-exclusive, worldwide, perpetual, royalty-free license to use, modify, publish, display, and distribute your content.

Content Responsibility: Members are solely responsible for their content. BraveHeartNation.com does not guarantee the accuracy, legality, or reliability of Member Content.

BRAVEHEARTNATION.COM CONTENT

BraveHeartNation.com Content, including trademarks, copyrights, and service marks, is owned by BraveHeartNation.com. Unauthorized use is strictly prohibited.

CONDUCT

PROHIBITED CONDUCT

You agree not to, under any circumstances:

1. Unauthorized Use:

• Do not use our Services for unlawful purposes or to solicit illegal activity.

1. Harmful or Illegal Content:

• Do not post content that is abusive, harassing, defamatory, deceptive, fraudulent, or invasive of privacy.
• Do not share unsafe medical techniques, links to harmful how-to instructions, or deceptive links.

1. Service Interference:

• Do not overload, hack, or disrupt the functionality of our Services or related networks.

1. Infringement:

• Do not misappropriate trade secrets or infringe copyrights, trademarks, patents, or proprietary rights.

1. Reverse Engineering:

• Do not reverse engineer, decompile, disassemble, or otherwise attempt to extract source code.

1. Impersonation:

• Do not impersonate others or solicit sensitive information unlawfully.

1. Spam and Exploitation:

• Do not collect personal data without permission or engage in unauthorized advertising or bulk emails.

1. Harm to Minors:

• Do not use the Services in ways that harm or exploit minors.

INTERACTION WITH OTHER MEMBERS

When interacting with other members of the BraveHeartNation.com community, you are expected to:

• Act courteously and exercise good judgment.
• Avoid sharing sensitive personal or proprietary information.
• Understand that you are solely responsible for your interactions. BraveHeartNation.com assumes no liability for disputes or damages arising from member interactions.

NON-DISCRIMINATION POLICY

We are committed to fostering an inclusive community. Discrimination based on race, religion, gender, disability, sexual orientation, or other protected characteristics is strictly prohibited.

Members violating this policy may be suspended or removed. If you experience discrimination, contact us with the subject “Non-Discrimination Policy.”

TERMS OF USE VIOLATION NOTICE

BraveHeartNation enforces a zero-tolerance policy for malicious conduct.

We reserve the right to permanently ban any account that violates our Terms of Use — without prior warning — if the behavior is deemed harmful, harassing, defamatory, impersonating, or disruptive to the platform or its members.

By creating an account or using our Services, you agree to these enforcement rights.

Repeat violations, impersonation, harassment, and use of fake or disposable emails (e.g. yopmail.com) may result in immediate account termination, IP bans, and potential legal action.

PROHIBITED ITEMS

We do not allow the promotion or discussion of:

• Drugs, hazardous materials, weapons, and items that promote violence or illegal activities.
• Nudity, mature content, and products from endangered species.
• BraveHeartNation.com reserves the right to remove listings that violate these rules.

MONITORING BY BRAVEHEARTNATION.COM

BraveHeartNation.com reserves the right to:

• Investigate possible violations of this Agreement.
• Suspend or terminate accounts without prior notice for conduct that breaches the Agreement.

PRIVACY AND SECURITY

PRIVACY POLICY

BraveHeartNation.com’s Privacy Policy outlines how we collect, use, and protect your information. By using our Services, you consent to these practices.

COMMUNICATIONS

• By signing up for text or email communications, you consent to receiving updates related to our Services.
• You may opt out anytime, but message and data rates may apply.

SECURITY

• While we take reasonable steps to protect your data, the security of your account also depends on you.
• Do not share your login credentials. Notify us immediately of unauthorized access or breaches.

FEEDBACK AND REFERRALS

FEEDBACK

• Any suggestions or ideas you provide to BraveHeartNation.com may be used without restriction, and we are not required to attribute you as the source.

REFERRALS

• By sharing contacts for referral purposes, you warrant that you have permission to provide their information.

DISCLAIMERS

BraveHeartNation.com provides its Services “as is” and “as available.”

• We make no guarantees regarding the accuracy, reliability, or availability of our Services.
• Participation in activities or reliance on any content is at your own risk.

We disclaim all warranties, express or implied, to the maximum extent permitted by law.

LIMITATION OF LIABILITY

BraveHeartNation.com and its affiliates will not be liable for:

1. Indirect, incidental, or consequential damages.
2. Loss of use, data, or profits arising from your use of our Services.

RELEASE AND INDEMNIFICATION

You agree to release BraveHeartNation.com from any liability arising from your use of the Services.

INDEMNIFICATION

You agree to indemnify BraveHeartNation.com for any damages, claims, or losses resulting from:

• Your breach of this Agreement.
• Your interactions with other members.

THIRD-PARTY SERVICES AND CONTENT

BraveHeartNation.com is not responsible for third-party links or content. Use these at your own risk.

SUSPENSION AND TERMINATION

We may suspend or terminate your access to the Services without notice for:

• Breach of this Agreement.
• Fraudulent or illegal activities.

GOVERNING LAW, ARBITRATION, AND CLASS-ACTION WAIVER

• This Agreement is governed by the laws of Puerto Rico.
• Disputes must be resolved through binding arbitration in San Juan, Puerto Rico.
• Class actions and jury trials are not permitted.

UPDATES TO THIS AGREEMENT

BraveHeartNation.com reserves the right to update this Agreement at any time. Major changes will be communicated in advance.

GENERAL

• Force Majeure: We are not liable for delays caused by factors beyond our control.
• Assignment: You may not assign this Agreement without prior written consent.
• Notices: Notices will be sent via email or posted on our website.
